<br />Today we completed measurements, mapping, and disturbance calculations for the entire encroachment and <br />also a calculation of the smaller gravel backfill area. These are attached to this letter and show approximately <br />.206 acre of disturbance including .068 acre of gravel backfill on the State Land Board property. In reality, <br />nedher property owner could mine the disturbed area in question now or in the future since slope stability along <br />the property line would require both parties to leave an "unmineable" amount. There has not been a loss of any <br />grazing potential with the fenceline's current location. <br />Ms. Rave's suggested to me that damages could possibly be equal to the royalty or market price on the 1000 <br />to 2000 CY of gravel, which could have been removed from the area. While this solution might be easy to <br />calculate, it does not agree with me in principle. Connell Resources has many mining operations in Routt <br />County and Colorado, and it is important to me to look our lessors and regulatory agencies in the eyes and <br />honestly say that we have never sold or profited from gravel on which we did not legally own. Before this <br />mistake I also could have said we have never violated our Mined Land Permits. <br />My intent and plan is to wait for your direction on inspection by the Division of Geology to verify the adequacy <br />of the gravel backfill and then recreate the of(sde bench between the property line and fenceline to it's previous <br />conddion. This will also require and allow for me to backfill and slope the interior western pit area. I would like <br />to complete this work within two weeks and get spring seed established before the heat of the summer and to <br />aid in stormwater management. <br />Ms. Rave also pointed out that our seeded area from last fall's reclamation had some white top showing. I <br />requested Routt County Weed Control to come out and do a spring and fall spraying Phis year, ro follow up on <br />last fall's spraying at this pit. <br />If you have any questions or comments please contact me at our office at 970-870-0200 or on my cell phone <br />at 970-846-4727.
