<br />REQIIEBT FOR A TECHNICAL REVISION FOR A MODIFICATION OF THE PERMIT <br />BOIINDARY AND CONBTRIICTION OF THE PROSPECT POND <br />Colowyo and the Division are in the final phase of review of <br />Colowyo's PR-O1 application submitted May 10, 1991. The PR-O1 will <br />add significant new areas to C-81-019. Unfortunately, public <br />notice requirements of the regulations require a significant period <br />of time (approximately 45 days) before the Division grants final <br />approval of PR-O1. This delay in final approval will result in a <br />serious delay in the start of construction activities for the <br />Prospect Pond and topsoil removal. Since our scheduled 1992 <br />topsoil removal in Sections 15 and 16 cannot start until the <br />Prospect Pond construction is completed, the delay jeopardizes our <br />ability to complete topsoil removal on schedule. <br />To partially remedy this conflict, we herein propose to <br />request a technical revision to modify our present five year Permit <br />C-81-019 under which we are currently operating. This Technical <br />Revision provides for a modification to the permit boundary <br />sufficient to provide for construction of the Prospect Pond. <br />We propose to add the following lands to the permit area: <br />Section 14 - Part of Lot 3 lying North and <br />West of State Highway 13, part of Lot 10 lying <br />West of State Highway 13, Township 3 North, <br />Range 93 West of the 6th P.M. <br />This 17.5 acre permit area addition is further delineated on <br />Attachment 1 - Modification to Permit Boundary/Pond Construction <br />Map. <br />The addition encompasses that area necessary to construct the <br />Prospect pond. The Division has at its disposal information with <br />PR-O1 to review the environmental resources applicable to the area <br />as well as the information necessary to review the Prospect Pond <br />proposal. <br />By utilizing PR-O1 Bond Information submitted to the Division <br />on March 31, 1992, the estimated bond cost to reclaim the Prospect <br />Pond is estimated to be $1,780 (see attachment #2). The addition <br />of this amount to the current liability of $8,345,539 will increase <br />Colowyo's total liability to $8,347,319, leaving a remaining <br />contingency of $400,086 to the present $8,747,405 Colowyo bond. <br />This technical revision does not provide any substantial <br />modification to that information submitted within PR-O1. It is our <br />intention that upon approval of PR-O1, the need for this technical <br />revision will be unnecessary as all future considerations for the <br />subject area is included in PR-O1. <br />
