Long <br />Division D'rxior <br />Re: Raton Creek Mine (C-82-055): Phase I Bond Release (SL-02), Propose <br />Decision to Approve, <br />Dear Mr.Ossola: <br />The Colorado Division of Minerals and Geology has issued a proposed decision to approve <br />a request for a partial release of the reclamation liability for the Raton Creek Mine. Please <br />find enclosed a copy of the Division's proposed decision document. <br />Regarding your letter dated November 10, 1994 involving long term maintenance of the <br />permanent stream channel diversion culvert in Starkville gulch, Energy Fuels Mining <br />Company is required to maintain this structure until final bond release is granted. Final <br />bond release may be granted after a minimum of ten years. The operator is currently <br />working with the landowner to commit to maintenance of this culvert beyond the mining <br />company's reclamation bond liability period. I will forward a letter of this agreement to you <br />once it has been received by the Division. <br />If you should have comments or objections to this proposed decision, you may request a <br />public hearing as described by Rule 3.03.2(6) in the Colorado Surface Mining and <br />Reclamation Act and Regulations.
