In reviewing your corroems and comments, we have gathered some more
detailed infonnatbn that wal help you assess our Terilnical Revision request
Addressing your conoems and comments...
1. The nclarrrstion cost for the Rex Quarry will be based upon rxlamatlon of 84.6 affected
acne to wlldi'Ifi- habitat. ao you roporlad.
As we reported on Juy 29, 1998, we estimated that we have amently affected 84.5 saes end
that the cost to redaim current disturbance along with demdition of existing buildings would be
5377,7330.23. We posted an interim bond in December, 1997 per your request fw a total of
5654,000. We estimated the cost of that interim bond eaeuming the total aifacted area of
1 114.8 aces would be disturbed We believe our current bond of 5654,01]0 is adequate iw the
trial aniktipated 114.8 aces of disturbance in our mine plan. The burden is on Cobrado Lien
' Company to request partial warranty release as the r~adaimed lend is deemed adequatey
restored by your Division. We do not wish to be Gm'Ited to a maximum d'ISiurbance of 84.5
~/ acres ea you hate suggested. We request that the 3654.000 of interim bond be considered
adequate for ttre affected aces of 114.8 proposed in our technical revision.
2. Sandstnrw hiphwalls andlor cI1Rs IeR In place sa part of nclsmation will be evaluated by the
Dfvislon Tor orwlonal sfabllity prior to Menelal wsrtanty nlsase.
We appreciate and understand this mmment.
