OF MINERALS <br />8 GEOLOGY <br />SUBJECT: REX QUARRY (M-77304) TECHNICAL REVISION - CLARIFICATION ON <br />RECLAMATION - Response to Adequacy Concerns 8/31198 <br />Dear Tom: <br />Thank you for discussing with me today your letter date August 31, 1998 addressing comments and <br />adequacy concerns. In reviewing your conoems and commerHs, we have gathered some more <br />detailed information that will help you assess our Technical Revision request <br />Addressing your concerns and commerHs... <br />1. The reclamation coat for the Rez Query will be based upon reclamation of B4.5 affected <br />acres to wildlfie habitat, as you neportad. <br />As we reported on July 29, 1998, we estimated that we have curently affected 84.5 aces and <br />that the oost to reclaim curent disturbano along with demolition of epsling buildings would be <br />E377,7330.23. We posted an interim bond in December, 1997 per your request for a total of <br />E654,000. We estimated the oust of that interim bond assuming the total affected area of <br />114.8 aces would be disturbed. We believe our curent bond of $854,000 is adequate for the <br />total anticipated 114.8 aces of disturbance in our mine plan. The burden is on Cobrado Lien <br />Company to request partial warrarriy release as the reclaimed land is deemed adequately <br />restored by your Division. We do not wish to be limited to a ma>amum disturbance of 84.5 <br />acres as you have suggested. We request that the $854,000 of interim bond be considered <br />adequate for the affected acres of 114.8 proposed in our tedmical revision. <br />2. Sandstone highwalls andfor eliHs left in place as part of reclamation will be evaluated by the <br />Division for erosional stability prior bD financial wararrty release. <br />We appreciate and understand this comment <br />
