The estimate needs to be adjusted to include these <br />costs. <br />Rule 2.03.4 -Identification of Interests <br />2. In the Applicant Violator System (AVS), Philip J. Goldsmith is listed as Resident <br />Agent. On permit page 778-3R (revised April 96, MR30) the Resident Agent is <br />listed as Wazd L. Van Scoyk. Either send the Division documentation (certified <br />Board Minutes, etc) showing an End Date for Philip J. Goldsmith as Resident <br />Agent so that AVS may be updated, or revise permit page 778-3R showing Philip <br />J. Goldsmith as Resident Agent. <br />Rule 2.04.13 -Annual Reclamation Reports <br />3. In the DMG review of the 1999 Annual Reclamation Report one question remains <br />outstanding. The DMG requested the depth of topsoil that was replaced, both at <br />the loadout and at the mine azeas, a copy of the seedmix planted and the seeding <br />rates. Please provide this information. <br />A grazing plan was approved for the Marr reclaimed area last summer. For all <br />future ARR's please provide a discussion of the grazing including: dates of <br />grazing, number of animals, location of grazing, whether or not any exclosures <br />were constructed, and visual observations regarding impacts of the grazing on the <br />reclamation. <br />Rule 3.02.2 -Reclamation Cost Estimate <br />4. As stated above, the cost estimate for reclaiming the open drill holes must be <br />included in the reclamation cost estimate. Please calculate the cost and add this <br />amount to the current liability of $1,576,635.00. <br />Since Kerr Coal Company has completed all reclamation, except the drill holes, <br />monitoring wells and two ponds, the DMG will not request that the reclamation <br />costs for the other mine areas be updated. Future phased bond releases will be <br />based on the current liability for those areas.
