This is the docuaent I <br />referred to in my presentatim to the Mined land Reclamation Board <br />last month. As of this date, I have rot sent a copy to the reclamation <br />board. I do rot know if this is the same dociment discussed by the <br />lender's attorneys or mt. Although certain concerns are shared with <br />other parties, rot all of my concerns are represented by either Mr. <br />Ranson, Mr. Flioch, or Mr. Bothers. My intuition is that the inter- <br />pretation of the recorded easement statement will be through the <br />courts at same point in time. <br />Each sales brochure included the statemelt enclosed herewith. I have <br />[brae brochures collected over the case of six years, with a statement <br />in each. I am surprised you or Castle staff have rot seen a brochure <br />of Cedar Heights. The brochuu-es were available from the Cedar Heights <br />guard office, which was frequatted by Castle Concrete staff. I would <br />recrnmatd that Castle Concrete expend as much effort in dissaidnating <br />their interpretation of the recorded easement. A good place to stazt <br />would be with the newly selected lender's marketing agents. <br />Irregardless of the easement, I have three major concerns with present <br />Castle Concrete operations, <br />1. TYaffic to and fr~ the quarry needs to regard the safety <br />of area residents and visitors. <br />2. The dust problem needs to be kept ua-der ccxltrol. I do not <br />believe property damage would be permitted by the easement, and I believe <br />I have suffered property damage. <br />3. I do rot understand the need to leave or dump piles of <br />material over and on the haul road. I would think reclamatim of hill- <br />sides along the access road would be expensive and unnecessary with <br />proper disposition of the material.
