We are requesting your assistance in helping us resolve this <br />matter. <br />Rule 4.08.4(7) of the Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining states: <br />"Except where lesser distances are approved by the Division, based upon apre-blasting <br />survey, seismic investigation, or other appropriate investigation, blasting shall not be <br />conducted within: <br />DIVISION OF <br />MINERALS <br />GEOLOGY <br />RECLAMATION <br />MINING•SAFETY <br />Bill Owens <br />Governor <br />Greg E. Walther <br />Executive Director <br />Ronald W. Cattany <br />Division Director <br />(a) 1,000 feet of any buildvng used as a dwelling, school, church, hospital, or nursing <br />facility; and <br />(b) 500 feet of facilities including, but not limited to, disposal wells, petroleum or gas- <br />storage facilities, municipal water-storage facilities, fluid-transmission pipelines, <br />gas or oil collection lines, or water and sewage lines". <br />Map 2.05.3-5 of the Lorencito Canyon Mine permit, entitled "Facilities Within 500' of Approved <br />Blasting Area", and submitted to our offices on November 1, 2002 in conjunction with our review <br />of TR-09, indicates blasting from the Lorencito Canyon mine's surface coal mining operations <br />may have occurred within 500 feet of two coal bed methane wells and two coal bed methane <br />pipelines. The wells of concem are identified on the latest version of Map 2.05.3-5 (received <br />December 13, 2002) as "OS-071-06976" and "OS-071-06968". The pipelines of concem are the 4- <br />
