Cattany <br />a, Division Director <br />Natural Resource Trustee <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC <br />Technical Revision No. 45, New Coal Refuse Pile, Fourth Adequacy Review Letter <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Bowie Resources LLC's (BRL) recent submittals dated April 4, 2007 and May 8, 2007 for Technical <br />Revision No. 45 (TR-45). The submittals were in response to the Division's second adequacy review letter <br />dated December 4, 2006 and its third adequacy review letter dated February 26, 2007. <br />All but three of the Division's adequacy concerns have been resolved. Item number 3, the COOT permit, <br />item number 26, alternative land use, and item number 27, Bureau of Reclamation permit, still remain. <br />The following is the status of the Division's questions and comments: <br />Section 2.05.3(3), Mine Facilities <br />Construction ofgob pile no. 3 would bury the dirt road that runs past the orchard. Who is the <br />owner of this dirt road'? <br />The Division has no further concerns. 1n the January 3, 2007 submittal, BRL responded that they <br />own the road. <br />2. Map 1 S does not show any access roads leading to the proposed new Jopsail stockpile and <br />coverfill pile. How will these two stockpile areas be accessed"? <br />The Division has no further concerns. BRL added a new temporary road to the designs. In the <br />submittal dated January 3, 2007, BRL revised pages Exh-8-180vi, Exh-8-31 and 2.05-25. In the <br />April 4, 2007 submittal, BRL revised Map I S-3, Map 21-3 and Figure I. <br />3. Please provide written confirmation that the Colorado Department of Transportation (COOT) <br />approves of the construction of a conveyor system over old State Highway 133. <br />BRL is working with COOT to obtain the permit. Please provide a copy of the approved permit <br />when it becomes available. <br />4.
