Cattany <br />~ Division Director <br />Natural Resource Trustee <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC <br />Technical Revision No. 43, New Borrow Area and Revised Drainage Plan <br />Dear Mr. Bear: <br />The Colorado Division of Minerals and Geology (Division) has finished its adequacy review of Bowie <br />Resources LLC's (BRL) submittal, dated July 7, 2006, for TR-43 for the Bowie No. 2 Mine. The submittal <br />was in response to the Division's adequacy review letter dated June 23, 2006. The following are the <br />Division's comments as well as several new questions and comments: <br />The application form submitted with the revision states that there will be an increase in disturbed <br />area of 2.8 acres. Page 4 ofExhibit IX indicates there are t 6 acres of disturbance with the borrow <br />area, and page 11 of Exhibit IX notes that the borrow area includes 4.6 acres to reclaim. Please <br />determine the actual proposed disturbance acreage and revise the pages to be consistent with the <br />actual proposed disturbance, as required by Rule 2.03.3(2). <br />The Division has no further concerns. The operator explained that, of the total disturbed acreage in <br />the borrow area, MR-66 accounted for 1.8 acres of disturbance and TR-43 accounted for the <br />remaining 2.8 acres of disturbance. Also, there is no discrepancy on page 4 of Volume IX. <br />2. BRL has an approved topsoil replacement depth of approximately 2 feet far the cover pile, topsoil <br />pile, and Gob Pile 2 disturbance areas. With the addition of the borrow area, TRL now proposes a <br />replacement depth of 0.5'. Based on the approximately 31.5 acre proposed disturbance (gob pile. <br />borrow area, cover pile area and topsail stockpile area), and a reported available topsoil volume of <br />55,813 cubic yards, it appears that BRL would have ample topsoil available for an approximate <br />replacement depth of 1.1 ' of topsoil. Please explain the rationale behind the proposal to reduce <br />topsoil replacement depth, and how this replacement depth would comply with the requirements of <br />Rules 2.04.9, 2.05.4(d), and 4.06. <br />In the submittal dated July 7, 2006, BRL revised Appendix A of Volume IX to show that the <br />topsoil replacement depth will be I foot. This revised topsoil cover depth is acceptable to the <br />Division. However, the Division requests that the revised Appendix A of Volume IX retain the <br />format and detailed information of the currently approved Appendix A. The detailed information is <br />needed to properly determine the reclamation cost estimate. In addition please revise page 2.05-38 <br />in Volume 1 to show that the topsoil depth wilt be 1 foot instead ofthe stated 2 feet. <br />3. BRL did not include an updated post-mining topography map, as required by Rule 2.O.i.4(2)(c). <br />Please revise Map 18, the currently approved post-mining topography map to include proposed post- <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
