Cattany <br />Division Director <br />Natu21 Resource Trustee <br />The Colorado Division of Minerals and Geology (Division) has finished its adequacy review of <br />Bowie Resources LLC's (BRL) latest submittal, dated March 17, 2005, for Technical Revision <br />No. 36 (TR-36) for the Bowie No. 2 Mine. The numbering in this letter follows the numbering in <br />the Division's first adequacy review letter dated February 11, 2005. <br />TR-36 was submitted in response to Stipulation No. 16. However, the geotechnlcal <br />report, dated January 13, 2005, that was submitted for TR-36 did not demonstrate that <br />the fill, as approved, will be stable with a minimum factor of safety of 1.5, nor was a <br />determination made of the site-specific characteristics of strength parameters of cohesion <br />and angle of internal friction of coal processing waste materials (the mix) actually placed <br />in the coal waste pile no. 2 embankment. <br />Therefore, the Division issued Notice of Violation No. CV-2005-002 for failure to provide <br />the necessary geotechnlcal demonstration required in Stipulation No. 16, the abatement <br />for which required the submittal of the necessary geotechnlcal demonstration. BRL <br />responded with the geotechnlcal report entitled "Geotechnical Engineering Study Bowie <br />#2 Mine Gob Pile "and dated March 17, 2005. The Division has reviewed this new <br />geotechnlcal report and has the following additional comments: <br />A. Please submit a certified, lazge scale design (plan and profile cross-sections) of the <br />coal mine waste embankment as it is now proposed to be built (steep lower <br />section and laid-back upper sections). <br />B.
