(C-81-019) <br />Technical Revision No. 50 <br />Response to the 11/22100 Division Technical Adequacy Letter #2. <br />Dear Mr. Walker: <br />The purpose of this letter is to provide a response to the 11/22/00 Division Technical Adequacy <br />Letter #2. <br />General Comments <br />Colowyo's understanding of the issues can be summarized by the following: <br />1) Colowyo agrees that upon approval of TR-50, there will no longer exist in Permit C-81-019 <br />any reclamation cost liability for any of the past coal exploration holes or associated disturbances <br />and access roads identified therein located within the subject Permit area. <br />2) Future bond coverage for such past reclamation work will be assigned under Notice of <br />Intent (NOI) X-95-109-5 under a current NOI amendment and bond release application. <br />3) Future coal exploration activities located both within and outside of the Permit area will be <br />permitted through the NOI process. Reclamation cost liability issues and bond release activities <br />will also occur through the NOI process. <br />Specific Comments <br />The following comments address the Division's specific concerns in the order in which they are <br />presented. <br />Item # 1 -The Division refers to an April 17, 2000 correspondence from Colowyo. We assume <br />the Division is referring to the April 14, 2000 correspondence. <br />Colowyo believes the Division's cited September 22, 2000 memorandum (from David Berry to et <br />al, Re: Technical Revision No. 50 -Colowyo Coal Mine - C-81-019) fails to address our <br />particular situation where we wish to otherwise properly manage selected drill holes after they are <br />no longer needed for the purpose of coal exploration. With respect to the selected drill holes, we <br />have informed the Division that all regulated coal exploration activities have ceased and our intent <br />has been to permit and "otherwise properly manage" the continued use of the wells under the <br />
