III IIIIIIIIIIIIIIII
STATE OF COLORADO
OFFICE OF THE STATE ENGINEER
Division of Water Resources
Department of Na[ural Resources
1313 Sherman S[ree[, Room 818
Denver, Colorado 80203
Phone (303) 866-3581
FAX 1303) 866-3589
Mr. Joseph J. Simpson
State Engineer
The Division of Water Resources has reviewed the proposed referenced Technical
Revision 73 as cited above and received on November 12, 1996, and provides the following
comments:
Dozer Basins
Appear to have no water resources impact providing they are not excavated with the
result of intercepting the ground water table. Dozer basins will drain to primary sedimentation
ponds and will apparently have their waters managed within the overall hydrology plan.
Stock Ponds
Stock ponds are described as permanent watering basins for future livestock grazing and
are structures which if constructed on water courses that are normally dry and involve dam
construction will meet the definition of the Livestock Water Tank Act of Colorado, C.R.S. 35-
49-101 thru 1 16, providing they are less than 15 ft. height.
Pursuant to C.R.S. '35-49-106 applications for said livestock tanks should be made as
required by law.
Therefore, in summary, this office has no objections to the proposed technical revision
and only advises that the "stock ponds" appear to require livestock tank permits according
to statute.
Sincerely,
,;~J,/~
~llC~•""s
Chuck Roberts
Professional Engineer 111
RECEIVED pF Cp~q
NR' `~
NOV 2 7 199fi ••~ ~,•
~ IB l6 ~
~RI~IWf• i)I fr1~H~iaR fr q~uW9$ Roy Romer
Governor
' 'lames S.
