Remaining structures, of which <br />the Division is aware, include the railroad siding and sediment control structures. The railroad <br />siding has been approved for permanent retention, based on a request from Santa Fe. A copy of the <br />request is enclosed. If the railroad tracks will interfere with the reservoir, the City of Florence <br />would need to work out a plan for their removal with EFCI and Santa Fe. The sediment control <br />structures (ditches, ponds, straw bales and silt fences), will be removed when EFCI demonstrates <br />to the Division that the structures aze no longer necessary to prevent contributions of suspended <br />solids from disturbed azeas in excess of premining levels or that of adjacent non-mined azeas. <br />For your information, I will explain how the bond release process works for coal mines. <br />Phase I bond release, as EFCI is requesting, is granted when the Division determines that <br />disturbed azeas have been backfilled, regraded, and drainage has been reestablished in <br />accordance with the approved plan. Up to 60% of a bond can be released under a Phase I <br />release. Sediment control measures usually remain in place until Phase II release is granted. <br />Phase II release occurs when the Division determines that topsoil has been replaced as <br />required, and vegetative cover meets the approved cover success standazd, and the azea no <br />longer contributes suspended solids offsite above premining or adjacent land levels. Up to <br />85% of the applicable bond can be released. <br />Phase III bond release occurs when the Division determines that all requirements of the <br />reclamationplan have been fulfilled, and reclamation success is equal to or better than the <br />approved success standazds. All remaining applicable bond is released. <br />The Division will be conducting an inspection of the Southfield Mine loadout, to evaluate <br />reclamation success as it pertains to EFCI's request for Phase I release, on October 1, 1997. You <br />aze welcome to accompany the Division on the inspection.
