Identification of Lands Unsuitable for Surface Mining and Reclamation <br />Pursuant to Section 522 of SMCRA <br />Through our land use planning process, all of the lands contained in <br />Federal Coal lease C-40672 and the unleased lands that are proposed <br />for including within the permit boundary have had unsuitability <br />applied. Through this application of unsuitability none of these <br />lands were designated unsuitable. <br />4. Conflicts Between Postmininq Land Uses and Existing BLM Land <br />Management Plans and Policies <br />The subject plan does not create a conflict between postmining land <br />uses and our existing Management Framework Plan or proposed Resource <br />Management Plan for these lands. <br />5. Adequacy of Measures to Protect Federal Resources Not Covered b <br />Exhibit 4, Archaeological Report, page 4-14, states that no <br />protection measures will be necessary for site SRT428. This <br />statement is not adequate and we will require a statement that this <br />site will be avoided, or a discussion of other appropriate mitigative <br />measures. <br />Some unleased Federal coal and other Federal mineral estates have <br />been included in the proposed modification to permit boundary No. <br />C-81-071. In order to protect the public interests associated with <br />these resources the mine plan must show that no subsurface mineral <br />development or exploration activity will take place on any ]ands <br />contained in the Little Middle Creek Life-of-Mine Plan area where all <br />or part of the Federal mineral estate is not leased to Cyprus Western <br />Coal Company without obtaining the appropriate Bureau of Land <br />Management lease, license, or permit. The plan must state that <br />unleased Federal minerals within the permit boundary will not <br />preclude issuance of other federal permits, licenses, or leases to <br />prospect, develop, or produce deposits of Federal minerals within the <br />coal mine permit boundary. <br />Arly questions Concerning item 1 may be directed to Jerry Strahan at (303) <br />824-8261.
