Stipulation No. 14 was <br />added to the permit as a condition of MR-016 approval. <br />The mine plan for the Sanborn Creek Mine did include mining both <br />the C-Seam and B-Seam prior to the change provided for in MR-016. <br />However, two seam mining was limited to a maximum cover of 1200 - <br />1500 feet except for some bleeder entries that were to be developed <br />in the C-Seam. Single seam mining, (B-Seam), was to proceed to <br />greater depths but rib, floor and roof stability problems are <br />expected to intensify. <br />Stipulation No. 14 is to broad because it would be triggered when <br />pillars were pulled from high cover areas (>1200 feet) in the B- <br />Seam. Please consider revising the language of Stipulation No. 14 <br />as follows: <br />SOMERSET MINING COMPANY MUST SUBMIT A MINE PLAN CHANGE <br />TO, AND RECEIVE APPROVAL FROM, ALL APPLICABLE STATE AND <br />FEDERAL AGENCIES BEFORE PULLING PILLARS FROM THE B-SEAM <br />UNDERNEATH ANY UNMINED LOW COVER, (LESS THAN 1200 FEET <br />OVERBURDEN), C-SEAM AREAS WITHIN FEDERAL COAL LEASE COC- <br />53510. <br />Please call if you have any questions. <br />Sincerely, <br />u.J ~~_ <br />Jim Stover, P.E. <br />Consulting Engineer <br />cc: Basil Bear <br />
