The purpose of this letter is to supplement our letters to you dated June 11, 2003 and May 16, 2006 <br />with additional comments after reviewing these materials. Specifically, we consider the following documents <br />additional materials: <br />• Transmittal from J.E. Stover & Associates dated November 14, 2006 containing the following: <br />o "Final Geotechnical Investigation and Evaluation Report" revised November 6, 2006 (hereafter <br />Yeh, 2006) <br />• Transmittal from J.E. Stover & Associates dated December 28, 2006 containing the following: <br />o Microseismic Monitoring Report, Third Quarter 2006, Bowie Resources, LLC <br />o Page 19 of GEI, 2002 report revised 12/22/06 (specifically item lb amended) <br />• Transmittal from J.E. Stover & Associates dated March 6, 2007 containing the following: <br />o Microseismic Monitoring Report, Fourth Quarter 2006, Bowie Resources, LLC <br />• Bowie Resources, LLC Micro-seismic Monitoring Program Overview dated February 13, 2007 (received <br />February 13, 2007 during a meeting with the CDRMS, Bowie Resources, and others at the USDA Forest <br />Service office in Paonia, CO) <br />It is our intent to provide comment on the above items and to bring our review current with respect to our opinion on <br />the potential impact ofmine-induced seismic activity on the safety of Bruce Pazk Dam. As stated in both the June <br />11, 2003 and May 16, 2006 letters, we continue to support previous conclusions that the risk of failure ofBruce Park <br />Dam due to seismic loading from long-wall mining appears minimal. Therefore, our review comments are limited <br />to mine-induced seismic impacts to the massive landslide located upstream of the right abutment of the dam. As <br />shown previously, there is warranted concern over the potential failure of the landslide and its impact to safety of <br />Bruce Park Dam. <br />
