Simpson, P.E. <br />State Engineer <br />CONDITIONS FOR APPROVAL <br />^ The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground <br />water must not occur during or after mining operations. <br />® The purpose of this amendment is to increase the permitted mining area from 186 acres to 241 acres <br />The 55 acres to be added to the site are currently part of the Kauffman Pit (M78-327). This amendment <br />will also change the final reclamation plan to include two storage reservoirs. The mining operation will <br />consume ground water by: ®evaporation, ®dust control, ®reclamation, ®water removed in the <br />mined product, ®processing, ^ other: <br />® According to our records, on November 12, 2004 the State Engineer's Office approved a temporary <br />substitute water supply plan ("SWSP") for the Wagner/Kauffman site. Also a well (gravel pit) permit was <br />approved for this site under permit no. 53207-F. With the proposed amendment, the applicant will need <br />to ensure the water consumption by the gravel operation at the Wagner/Kauffman Pit is included in the <br />SWSP. The applicant will need to amend its SWSP if the proposed uses are not included in the current <br />SWSP for the Wagner/Kauffman Pit. <br />^ The proposed operation may have potential impact on existing water rights near the project location. <br />Applicant needs to demonstrate that the proposed project will not alter or impact the historic operation of <br />existing water rights. <br />^ The applicant has indicated plans to use other water for purposes at the permit site. The source <br />of water for this use is to be obtained from Applicant needs to document that this water was <br />diverted in priority under a water right decreed for such industrial use. Applicant should contact the <br />water commissioner for further information. <br />^ The applicant has not identified any proposed use of water at the permit site. If water will be used for <br />any purpose at this site, the applicant will need to document that the water was obtained from a legal <br />source, or the water was diverted in priority under a water right decreed for such industrial use. <br />COMMENTS: If storm-water runoff is intercepted by this operation and is not diverted or captured in priority, it <br />must be released to the stream system within 72 hours. This may require a discharge permit from CDPHE- <br />WOCD. Otherwise, the operator will need to make replacements for evaporation. <br />The applicant may contact the State Engineer's Office with any questions. <br />
