The <br />modifications to the pond referred to on page 350 will not be executed until the following is completed: <br />• Vegetation restored to regulatory standards <br />• Sediment loading demonstrations completed to show that sediment loading for post mine <br />conditions are equal to or less than sediment loading from pre-mine conditions <br />• The NPDES permit removed <br />Proposed modifications to the pond once all necessary demonstrations are complete and approved are <br />outlined on page 427Rc (revised 6/98,RN-03). Given the size and volume of the proposed modified pond, <br />no other state pemuts will be required. Page 427Rc addresses all the requirements for Rule 4 .05.17. <br />3. The feldmark that EFMC committed to complete by Augurt 31, 2002 mar not entirely completed The south aaerr <br />road ditch grading and the rtram bale repair at the inert end of the 100year ds3cb mar noted ar incomplete during the <br />Augurt 29, 2002 inspection. This mark must be completed by the end of September 2002 to avoid enforcement action. <br />Response: Refer to the September 11, 2002, letter submitted by EFMC <br />Also attached is a summary of revisions and additions to assist you in updating the permit. <br />In addition to the text changes related to the Permit renewal response, EFCM revised the text and maps to <br />clean up a few inconsistencies found during our review of the existing permit.
