March 30, 2006 <br />Mr. Byron Walker <br />Re: Hayden Gulch Loadout, Permit C-92-081 <br />Responses to Midterm Permit Comments <br />Page 14 <br />by the Avian Power Line Interaction Committee, The Edison Electric Institute and the U.S. Fish and <br />Wildlife Service. <br />All electrical transmission lines (i.e., the 69 KV line and the three-phase overhead power lines) that <br />transect the permit boundary, as well as, the electrical substation aze owned, operated and <br />maintained by Yampa Valley Electrical Association (YVEA). Right-of--Way Easement agreements <br />for the power transmission lines and substation are presented in Appendix 3-4. <br />The 69 KV transmission line that runs through an easement along the west margin of Section 14 and <br />the east margin of Section 15 (see Exhibit 3-lA), as well as the electrical substation located adjacent <br />to the office/change building were constructed in 1978 - 1979. The Loadout was owned and <br />operated by H-G Coal Company. HGTI can only assume that the electrical transmission line and <br />substation were constructed using the best technology available when they were constructed. The <br />69 KV line is the only overhead power line that runs to and from the substation. All power for the <br />facilities area is provided through buried underground lines. Lights on the poles in the vicinity of <br />the Truck Dump Hopper aze powered via the underground lines. <br />HGTI has spoken with YVEA regarding avian protection guidelines and understands that the current <br />guidelines (i.e., APP Guidelines [April 2005]) would be applicable to new construction, as well as <br />rep{acement and repair (e.g., rotten transmission line pole) of existing facilities. <br />Should you or any other member of the Colorado Division of Minerals and Geology (CDMG) staff <br />have any questions regarding this information please do not hesitate to contact the undersigned at <br />970-871-6125. <br />Regards <br />Hydro-Environmental Solutions, Inc. <br />(on behalf of Hayden Gulch Terminal, Inc.) <br />John C.
