(HGTI), enclosed are three (3) copies of Technical <br />Revision No. 7 (TR-07), which contains responses to the Colorado Division of Minerals and <br />Geology (CMDG) Midterm Permit Review of November 9, 2005. This submittal contains the <br />required application form, proposed public notice, insertion instructions for updating the permit <br />application package (PAP) and the revised materials and information. Each CDMG comment is <br />provided below (in italics), as well as, HGTI's response following the comment. <br />Please note that in addition to addressing CDMG's review comments this response package contains <br />updated information on the HGTI -Peabody Energy Corporation Organizational Family Tree and <br />officers and directors, as well as, an updated weed management plan. The PAP currently contains <br />an existing, approved weed management plan in Tab 17. The updated weed management plan was <br />prepared for the Routt County Weed Department -HGTI is submitting this updated plan to CDMG <br />to assure that Routt County and CDMG have our most current weed management plan, and that our <br />operations remain in compliance with Rule 4.15.1(5). The accompanying insertion instructions <br />include instructions on where this information needs to be inserted into the PAP. <br />Rules 2.03.5/2)LC) and (e) <br />Item 1. Page 7, Tab 3. The entry under Statement of Bond Forfeiture does not indicate the <br />current (resolved) status of the bond forfeited in 1986 for Kentucky permit #8980140 <br />(resolved on May 14, 2004, see Stipulation 6, complied with). Please clarify the <br />current status in the Permit Application Package. <br />Response: Page 7 of Tab 3 in the permit application package (PAP) has been updated to reflect that <br />bond forfeiture for Kentucky permit #8980140 has been resolved. <br />Rule 2.03.6(1) <br />Item 2.
