Colorado 80203-2273 <br />RE: Lariat Mine M-77-251 <br />Mine Inspection Corrective Action conducted May I, 2000 <br />SENT VIA FAX (303) 832-8106 AND MAIL <br />Dear Mr. Mount: <br />RECEIVED <br />AUG ; 1 ~OG7 <br />OiYision of Minerals and Geology <br />In regard to Corrective Action NI noted in the Minerals Program Inspection Report for the Lariat Mine, <br />Robinson Brick Company (Robco) is asking fora 2nd extension to the original corection dated noted in the <br />report. The original correction date was 7/I 1/2000 and in a letter dated July 7d' from Robco, a 30 day <br />extension was requested until August 10, 2000. The 2nd extension request is for 60 days. <br />During the period of the lst extension, please see the attached corespondence between the State Engineer's <br />office and Robco in this regard. In addition, on July 12'", Robco made a site visit to Lariat with Mr. Greg <br />Hammer, Senior Professional Engineer with the Dam Safety Branch to discuss the current sima[ion. Based <br />on [he meeting with Mr. Hammer, Robco obtained a "Non-Jurisdictional S[a[us" dam permit as the two <br />attached letters describe. However, in the letter dated July 20.2000 from Mr. Richard Stenzel approving <br />the structure, [he subject of water rights was raised. <br />As the letter from Mr. Stenzel requested, 1 first contacted Denise Miller on July 26d' but it wasn't until <br />August 9'" [ha[ she verbally concluded [ha[ no water rights issues were involved if [he containment <br />sVUCture was classified as an Erosion Control Dam (ECD) with two acre-feet of capacity or less. <br />An ECD requires a permit from the Office of the State Engineer and perhaps some additional modification <br />of the existing structure.
