The applicant is advised that storage of greater than 2 acre-foot <br />of water in each structure may require water rights and an <br />application for a "stock tank" with the State Engineer's office. <br />e. As these sediment control structures are considered point source <br />discharges, the applicant should contact the Water Quality Control <br />Division to obtain a discharge permit. A permit is required even <br />though discharges may be infrequent. <br />Exhibit E - Reclamation Plan <br />5. This comment concerned stability of the waste rock disposal facility. <br />The Division agrees in general with the discussion provided, however, a <br />concern remains on the channel stability at the edges of the fill where <br />the fill abuts against the natural hill slope. There will be a tendency <br />for runoff to cut into the fill because this material is fine-grained and <br />the slope has been steepened considerably over natural conditions. The <br />Division recommends a plan be submitted for insuring the channels along <br />the edges of the waste rock disposal area are stable at the time of final <br />reclamation. <br />6. The response on land application of sewage sludge is adequate. <br />7. The response on reclamation of the sediment ponds is adequate. <br />8.
