Re: Incomplete Application, Kerr Coal Company, Marr Mine, Permit No. C-80-006
Dear Mr. Nettleton:
On September 7, 1995, the Division received an application for a renewal of the Marr Mine
permit. The Division finds this application incomplete at this time, for the following reasons:
1. The application form submitted with the application package is for revisions to permits,
rather than for permit renewals. The renewal application form is transmitted herein.
In addition to this completeness item, three other items were found to be noteworthy at this
time:
2. The newspaper notice lists Section 15 of Township 9N, Range 78W, as being within the
Marr Mine permit area. A review of the current permit seems to indicate that Section 15
may no longer be within the permit area. Please address.
3. The Certificate of Insurance submitted with the application indicates an expiratic n date of
October 1, 1995. This certificate will need to be replaced within the next 30 days with one
reflecting a renewed insurance policy.
4. The Certificate of Insurance does not specify coverage for the Marr Mine. This is typically
placed in the section of the certificate labeled "Description of Operations." Sucll a
reference would typically be "Marr Mine - CDMG Permit No. C-80-006."
The Division requests Items 1 and 2 be addressed as soon as possible, as a renewal application
for the Marr Mine must be found complete by September 22, 1995 for Kerr Coal Company to be
allowed to exercise its right of successive renewal, if necessary, upon the permit's expiration
