The Division has conducted a preliminary adequacy review of Mine Development Inc.'s (MDI) application to
convert the Neglected Mine from a 110 Designated Mining Operation (DMO) to a regular 110 operation.
Please respond to the following ~:omments, concerns and requests for additional information as soon as
possible so that the decision due date of January 13, 1995 can be met. Please be aware that these are only
preliminary comments and that additional comments may be sent to MDI in the next few weeks concerning
the adequacy of the conversion application.
In response to your inquiry about the need for MDI to compile an Environmental Protection Plan to satisfy the
DMO requirements; MDI may submit a written request for an extension, not to exceed one year as provided
for in Rule 7.2.3(3)(cl, of the time allowed to file an Environmental Protection Plan, due to the current review
of the conversion application.
ADEQUACY REVIEW COMMENTS
Application Package
1. The post-mining land use appears to be dryland pasture rather than rangeland. A rangeland
designation would require the re-establishment of shrubs and trees on the site. If MD1 wishes to
restore the site to rangelan~f, the revegetation seed mix should be revised to include native shrub and
tree species. Additionally, shrub and tree transplants would be recommended. If dryland pasture is
desired for the post-mining land use, that page of the application should be revised accordingly.
2. The legal description on the application form and in Exhibit A should be to the Quarter/Quarter
section, or NW/4NE/4. Please revise these accordingly.
Exhibit B
Because of the small size and limited production plans for the Neglected operation, no specific
restrictions regarding wildlife will be required. However, MDI should identify and secure any areas
of the mine which may pose potential risk to wildlife.
