Please be aware that these are only <br />preliminary comments and that additional comments may be sent to MDI in the next few weeks concerning <br />the adequacy of the conversion application. <br />In response to your inquiry about the need for MDI to compile an Environmental Protection Plan to satisfy the <br />DMO requirements; MDI may submit a written request for an extension, not to exceed one year as provided <br />for in Rule 7.2.3(3)(cl, of the time allowed to file an Environmental Protection Plan, due to the current review <br />of the conversion application. <br />ADEQUACY REVIEW COMMENTS <br />Application Package <br />1. The post-mining land use appears to be dryland pasture rather than rangeland. A rangeland <br />designation would require the re-establishment of shrubs and trees on the site. If MD1 wishes to <br />restore the site to rangelan~f, the revegetation seed mix should be revised to include native shrub and <br />tree species. Additionally, shrub and tree transplants would be recommended. If dryland pasture is <br />desired for the post-mining land use, that page of the application should be revised accordingly. <br />2. The legal description on the application form and in Exhibit A should be to the Quarter/Quarter <br />section, or NW/4NE/4. Please revise these accordingly. <br />Exhibit B <br />Because of the small size and limited production plans for the Neglected operation, no specific <br />restrictions regarding wildlife will be required. However, MDI should identify and secure any areas <br />of the mine which may pose potential risk to wildlife. <br />
