Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology hereby issues nofice, in accordance with Title 34, Article 33, Section 126, Paragraph 4, <br />of the Colorado Revised Statutes, that on September 7, 2005, an application to revise coal miniug operations at the Munger <br />Canyon Mine was wnsidered complete for the purposes of filing. The revision was submitted by Central Appalachia Mining, <br />LLC. All review and comment periods as provided in the Act and the Regulafions initiate from this date of filing. <br />This revision allows for modification of the coal waste disposal area sediment pond, including elimination of the existing open <br />channel emergency spillway and installafion of a 21%pipe emergency spillway. Project would involve sediment removal from <br />an adjacent ephemeral channel segment that was impacted by a recent flood event. <br />The underground coal mining operation is on land located approximately 18 miles North of Loma, Colorado. The permit azea <br />is further described as follows: <br />Mine site: Portions of Sections 27, 28, 29, 33, and 34, T7S, R102W, 6th P.M., all in Garfield County. <br />Portions of Sections 2, 3 and 4, T8S, R102W, 6th P.M., all in Garfield County. <br />Rail Loadout: Portions of Section 34, TZN, R3 W, Ute PM, in Mesa County. <br />Portions of Section 3, TIN, R3 W, Ute PM, in Mesa County. <br />The area affected by the proposed revision is at the mine site in Garfield County. The mine site location is covered by USGS <br />7.5 minute Quadrangle maps of Howazd Canyon, and Garvey Canyon. <br />The applicant is required to publish notice in a local newspaper that this application has been deemed wmplete. At the time of <br />publication of this notice, the applicant is additionally required to place a copy of this applicaton at the Mesa County Clerk and <br />Recorder, P.O. Box 20,000, Grand Junction, CO 81501, and at the Division office.
