Box 310 <br />San Luis, CO 81152-0310 <br />Re: San Luis Project, Permit No. M-88-112 <br />Dear Ms. Hayes: <br />I finally have had an opportunity to review yow correspondence dated July 10 and i 11, 1995 <br />regarding a few outstanding matters at the San Luis Mine. As you stated in yow Jply 11, 1995 <br />letter, the problem you have with the M-14 well will be resolved this month. Wheh it is resolved, <br />send me a letter outlining what was done to take caze of the problem. Also, you stated that the size <br />of the containment area for the make-up water tank overflow had to be reduced be ause of "the sofr <br />ground in the southwest corner." Please provide the Division with an as-built dra 'ng of the final <br />structure so an accwate document can be placed in the files. <br />In your July 10, 1995 letter, you outlined the then current status of several outstan ling items. There <br />have been quite a few changes since July 10, including: (1) the Division's approv I of TR-017 and <br />conditional approval of TR-018, (2) yow response to the M-14 monitoring well pr blem, (3) yow <br />submittal of TR-023 addressing the discontinuation of monitoring requirements for ten piezometers <br />and the once-a-week sampling of the Inco tailings, and (4) yow response to the spi of distance issue. <br />The list of outstanding issues grows smaller every month. <br />As you pointed out in paragraph E of yow July 10, 1995 letter, you will be submitting an <br />amendment (technical revision) to the permit changing the post-mining land use foy~ the old office <br />site. You indicated a concern about my request for water samples from the water ells at the site. <br />The reason 1 suggested taking samples from the water wells is in regard to the requirement of <br />Rule 3.1.7(8), which states, "An operator shall demonstrate, to the satisfaction of t e Office, that <br />reclamation has been achieved so that existing and reasonably potential futwe use f groundwater <br />are protected." You may not be able to demonstrate protection of groundwater wit out sampling the <br />water wells. If you can demonstrate that the groundwater was not adversely imps ed from the heap <br />leach operation without the water samples, then provide the information when you submit your <br />release request. <br />
