Rationale for TR-06 Approval-Western Mobile Page 2 <br /> Deepe Farm Pit, Permit No. M-81-302 <br /> September 15, 1997 <br /> directed by the notice to provide written comments to the Division by 5:00 p.m. on <br /> September 2, 1997. On August 20, 1997, a copy of the public notice soliciting <br /> comments on technical revision TR-006 was sent to landowners and easement holders <br /> within 200 feet of the affected land. <br /> 2. In addition to following the public notice procedures that would be normally applied <br /> to a new Limited Impact (type 110) Permit application, the Division, on August 20, <br /> 1997 mailed a copy of the public notice soliciting comments on technical revision <br /> TR-06 to all persons and agencies that had submitted written comments on the <br /> application for amendment AM-02 to the Deepe Farm Pit Permit. Amendment AM-02 <br /> to the Deepe Farm Pit Permit was approved with conditions by the Mined Land <br /> Reclamation Board during a hearing held on June 26, 1997. The modifications to the <br /> Deepe Farm Pit perimeter levee that are proposed in the technical revision TR-06 <br /> application were an issue that many objectors to amendment AM-02 wanted the <br /> Board to consider during the June 26, 1997 hearing. As such, the Division considered <br /> it to be appropriate and within the spirit of the Board's order that interested parties <br /> to amendment AM-02 be provided an opportunity to comment on the technical <br /> revision TR-06 application and that these persons and agencies be specifically <br /> notified. <br /> 3. During the hearing on July 23, 1997, the Board expressed an interest in the <br /> jurisdiction that various flood plain management agencies may have over the Deepe <br /> Farm Pit perimeter levee. The Board further indicated that comments on the <br /> technical revision TR-06 application should be solicited from such agencies. In order <br /> to carry out this direction from the Board, on August 20, 1997 public notice soliciting <br /> comments on technical revision TR-06 was sent to the staff of the Colorado Water <br /> Conservation Board, the Urban Drainage and Flood Control District, and the Federal <br /> Emergency Management Agency. The local land use authority with flood plain <br /> jurisdiction at the Deepe Farm Pit location is Boulder County. As an objector to the <br /> amendment AM-02 application, and as the local land use authority, Boulder County <br /> was also provided the public notice soliciting comments on the technical revision <br /> TR-06 application. <br /> Review of TR-06 <br /> The technical revision application comprises a proposal to modify the side slopes and raise <br /> the crest elevation of a portion of the Deepe Farm Pit perimeter levee. The initial <br /> construction of this levee predates the issuance of a Reclamation Permit for the Deepe Farm <br /> Pit. The operator provided a map with the TR-06 application that depicts the proposed final <br /> configuration of the levee using 2-foot contours. The following issues were raised by the <br /> Division regarding the adequacy of the TR-06 application under the Land Reclamation Act <br />
