MANAGEMENT <br />The DMG's letter dated December 22, 2000 transmitted its adequacy comments <br />regarding the referenced technical revision. Following are PCC's responses to the DMG's <br />comments and concerns: <br />2.03.5 Compliance Information <br />1. The Virginia and West Virginia violations listed in permit stipulation No. 23 were <br />linked to PCC through David Gay and David Duffy, persons who previously owned <br />or controlled PCC. Since these individuals no longer own or control PCC, the <br />subject violations should no longer be tied to PCC. Please refer to Volume I, Tab <br />3, Appendix 3-1 to confirm these individuals no longer own or control PCC. <br />Powderhorn Coal Company is adebtor-in-possession having filed a petition for <br />bankruptcy (Chapter 11) in the U.S. Bankruptcy Court. Powderhorn's bankruptcy <br />case is being administered with the bankruptcy case of its parent, Quaker Coal <br />Company, Inc. The delinquent AML fees are "prepetition" debts and are subject <br />to the automatic stay provisions of the Bankruptcy Code. The AML fees may not <br />be paid except in the context of an approved Chapter 11 plan or pursuant to a <br />valid order of the Bankruptcy Court. <br />2.05.3 4 Ponds. impoundments and diversions <br />2.
