(Lafarge) has prepared the following general timeline as an aid in <br />understanding the objections raised in the abovementioned correspondence from the O'Dell's <br />lawyer. This information is provided solely for the purposes of clarification of the issue "Legal <br />Right to Enter". <br />I would like to start by re-iterating Lafarge's opinion that none of the issues raised by the <br />O'Dell's Attomey have any merit. We have clearly shown legal right-to-enter for both the <br />original River Valley Resource permit and for this requested Amendment. It is also Lafazge's <br />opinion that the objections raised by the O'Dell's Attorney, Mr. Tremaine, are in fact mixing <br />"apples and oranges", that is, the supposed "cloud" on our legal right-to-enter that is referenced <br />by Mr. Tremaine concerned the original 105 acre permit area and has no bearing on the current <br />property that is included with the Amendment area. As shown below, this "cloud" was resolved <br />prior to the issuance o£ the original permit as substantiated by documents provided by Lafarge <br />from the Court and the Halsnes' themselves. The attachments to this letter have been provided <br />for convenience, as they are all part of the official DMG file on the original and Amendment <br />applications. <br />Amendment Timeline <br />April 11, 2003 Ms. Chiappone's Letter stating the need for additional clarification of the <br />Legal Right-to-Enter for the Amendment property, <br />April 30, 2003 Lafarge documents proving the Legal Right-to-Enter for the Amendment <br />property. <br />June 11, 2003 Letter from Ms. Chiappone confirming the acceptance of the River <br />Valley Resource Amendment as complete and beginning the 90-day <br />review period. <br />July 25, 2003 Letter to the DMG from Mr. Tremaine Objecting to Lafarge's Legal <br />Righ[-to-Enter the property referencing the Halsnes' suit (Note: This <br />Western U.S. Region <br />1400 W. 64th Ave., P.O. 60X 21588, Denver, Colorado 80221-0588 <br />Office: (303) 657-4000 <br />Web: www.lafargenorthamericacom <br />
