Canany
Division Director
Natural Resource Trustee
As we have discussed by telephone, the Division of Minerals and Geology (Division) has
identified, with regard to this TR, an item that still requires correction, and a review is to be made
of another. Please address the requests presented in the following items. Any revised or added
pages to the Permit Application Package (PAP) developed in response to these requests should be
submitted with the date of response annotated in the lower right hand corner. (An advance copy
of this letter is being transmitted by e-mail.)
Item 1. Exhibit 8u. Twentymile Coal Company was to review the proposed Scoria Storage Area
alternative sediment control proposal, and to consider an alternate design. Please advise the
Division of the status of this review and the potential submittal of an alternative design.
Item 2. Exhibit 8u. The SEDCAD demonstration submitted for the Storage and Training Area
does not demonstrate that there is no off-site impact from sediment carried in the runoff (the
demonstration omitted the sedimentology module). Please resubmit the demonstration to show
that the alternative sediment control procedures are adequate.
The current due date for a proposed decision on this technical revision is April 22, 2005. Please
request an extension of the proposed decision date to allow the Division ten days to review your
adequacy response(s).
Please call me if you have any questions.
Yours truly,
w~~
Byro G.
