EXHIBIT E <br />Reclamation Plan <br />Reclamation Limits <br />The mine will be reclaimed as a lined water storage reservoir with two interconnected cells. The <br />single reservoir cell that is in the current plan (approved in Technical Revision #3) will be <br />extended onto the southern portion of the amendment area tract. An additional reservoir cell will <br />be reclaimed in the northern portion of the amendment area tract. The two cells will be <br />interconnected via a pipeline so that the reservoir will function as one contiguous cell. The <br />configuration of the final reclaimed reservoir will be as shown in Exhibit F, Reclamation Plan <br />Map. <br />Methods and Criteria of Reclamation Activities <br />The current reclamation plan details the specific methods and criteria (topsoil handling, grading, <br />revegetation, seed mix, etc.) to be used in reclaiming the site. NCCI intends to continue to use <br />these methods. At this time a final liner design has not been completed. Until the final liner <br />design is completed NCCI commits to reclaiming the site with the clay liner approved in <br />Technical Revision #2 and commits to following the quality control plan approved in that <br />revision. This liner would satisfy the requirements of the "State Engineer's Guidelines for Lining <br />Criteria for Grave! Pits." <br />Reclamation Timing <br />Reclamation activities have not commenced to date on the site. As stated in Technical Revision <br />#3, NCCI is in active negotiations with a buyer for the reclaimed water storage reservoir site. <br />They are in the process of determining what the final liner configuration will be. When the final <br />liner configuration is determined, NCCI will start the reclamation and continue it concurrently <br />with the mining activities. <br />A phased and cumulative bonding approach has been approved in Technical Revision #3 to <br />ensure that NCCI has posted sufficient bond to reclaim the site at any point during the mining <br />activities.
