Further Drilling by KPK. Effective with the payment of the consideration provided for <br />in Paragraph 2 of this Agreement and further subject to the terms of the Agreement, KPK, for <br />itself and its successors and assigns, hereby covenants not to drill any new wells for the <br />production of oil and gas on the Glen Horton #2 Location. Provided, KPK reserves the right to <br />explore, produce and drill for oii and gas under said Glen Horton #2 Location, provided that it <br />does not do so by drilling on the Glcn Horton #2 Location or otherwise using the Glen Horton #2 <br />Location. <br />13. Notices. All notices, requests, demands and other communications required or <br />permitted hereunder shall be in writing and shall be deemed to have been fully given, made and <br />received only when personally delivered, received via facsimile that has been confumed <br />electronically, delivered by Federal Express or other nationally rewgnized courier service, or <br />three (3) days after having been deposited in the United States mail, postage prepaid, return <br />receipt requested.
