<br />Jurisdictional R'etlands <br />Feature G is a cattail marsh wetland that is connected to the surface water drainage <br />discussed above (feature D). The cattail mazsh wetland is located within the southwest <br />comer of the site. The azea of this feature is 2.75 acres (including the surface water <br />drainage channel through the cattail mazsh}. <br />Non-Jurisdictional Wetlands <br />The interpretation of what constitutes jurisdictional wetlands and waters of the United <br />States was altered by a United States Supreme Court decision (Solid Waste envy of <br />Northern Cook County v. U.S. Army Cogs of Engineers. No. 99-1178 (7anuazy 9, <br />2001)). In order to be regulated, one of two criteria must be pteseut in determining <br />whether waters or wetlands fall under the jurisdiction of the Corps; first the wetland or <br />waters must be surface connected to tributary waters of the United States, or second, the <br />wetlands or waters must be adjacent to tributary waters of the United States_ <br />Wetlands depressions A, B, C, E, and F aze isolated depressions that aze not adjacent to or <br />connected to a tributary system. These isolated depressions are located within the north <br />portion of the site. <br />Features H and I aze surface Swale drainages. These features are not connected to a <br />~, tributary system and are not adjacent to a tributary system. Both of the surface Swale <br />drainages are located east of the cattail marsh wetland (feature ~, <br />SUMMARY AND RECOMMENDATIONS <br />A survey for wetlands and waters of the United States was conducted within the NCC <br />Pit #1 extension in Weld County, Colorado on Match 29 and April 26, 2004. A surface <br />water drainage skirts the west boundary of the site and flows across the northwest corner <br />of the site (feature D). Feature G is a cattail marsh wetland that is adjacent to the surface <br />water drainage. Both the surface water drainage and the cattail marsh wetland aze <br />jurisdictional features within the site. Wetlands depressions A, B, C, E, and F are all <br />isolated depressions that are not adjacent to or connected to the any tributary system. <br />Features H and I are isolated surface Swale drainage's that aze not connected to a tributary <br />system or adjacent to a tributary system All of the wetland depressions within the north <br />portion of the site and both isolated surface Swale drainages east of the cattail wetland <br />marsh are non-jurisdictional wetland features of the site. The southwest drainage (and <br />adjacent wetland fringe) comprises 0.16 acres within the project site. The cattail marsh <br />wetland (and surface water drainage channel within this area] comprises 2.75 acres within <br />the project site. <br />We recommend obtaining a concurrence from the U.S. Army Corps of Engineers Omaha <br />'~.
