Long <br />Division Dnector <br />The Division received comments from the Division of Wildlife (DOW) regazding the Lyons Pit <br />Amendment 006, Permit No. M-74-015. Under Rule 6.4.8(2), the application shall be reviewed <br />and commented upon by the DOW prior to the Boazd's consideration of the application. The <br />following DOW recommendations were noted in the December 6, 19991etter; <br />The DOW recommends that known and existing wetland areas, wet meadow azeas, and <br />mature cottonwoods and willow communities be avoided by the mining process and be <br />allowed to remain unaltered whenever possible. <br />2. DOW recommends a minimum 100-foot setback from the St. Vrain Creek and South Branch <br />ripazian condors. <br />In order to increase chances of nesting success of both bobolinks and savannah sparrows, the <br />DOW recommends delayed haying in nesting habitat until July 15 as mentioned in Jones' <br />report. DOW agrees that a through search for nest in Phase II and III grasslands and hay <br />meadows take place prior to initiating mining and that a monitoring program for populations <br />take place during mining and reclamation. <br />4. The DOW recommends that the prairie dogs be either moved alive to another location or <br />humanely killed before any earth moving occurs. <br />5. Since western burrowing owls use prairie dog towns and live in prairie dog holes, the <br />following should be observed: <br />
