CD $1410 Orvision Direcor <br />RE: Hallenbeck Pitlfl, Adequacy Review, Permit No. M-77-062 <br />Dear Mr, Benson: <br />[ have completed my review of your application for conversion to a 112 permit for the Hallenbeck Pit. My adequacy <br />concerns listed below should be addressed and resolved if possible by March 24, 1994. Since we have received several <br />letters of concern from the local ci[iuns we will schedule this [natter during the April 20-21 Board meeting as a formal <br />public hearing. Prior to the hearing we will hold an informal conference and apre-hearing conference in Delta to <br />determine the issues to be discussed at the Board Hearing. I will notify you if the location, date and time of the <br />informal conferences as this information becomes available, <br />Benson Brothers is required to notify all owners of record of surface rights to the affected land and all owners <br />of record of lands that are within 200 feet of the boundary of the affected land. We have received en objection <br />letter from Mr. Fred Dixon who apparently is a property owner who was not notified. Enclosed is the letter <br />from Mr. Dixon. Please explain [he status and location of Mr. Dixoo's property and whether he was properly <br />noticed. <br />2. There appears to be several adjacent homeowners within Z00 fee[ of the proposed affected land. Our rules and <br />regulations require that your proposed mining operation will not adversely affect the stability of any significant, <br />valuable and permanent man-made stntcmre(s) located within two hundred (200) feet of the affected lands. <br />However, where there is an agreement that damage [o the structure is to be compensated for by the <br />applicanUoperator (C.R.S. 34-32-115(4)(d)), then mining may occur within 200 fee[. Proof of an agreement <br />must be submitted to the Division prior to the decision date. Please address. <br />3. 'The reclamation plan map shows that slopes of 2:1, 3:1, and 5:1 will be created during the backfill and grading <br />process. Please define the volume, in cubic yards, of material to be moved to achieve these desired slopes. <br />4. Please indicate the number of acres of border and critical areas [o be revegeta[ed according to [he <br />recommendations of the Soil Conservation Service. <br />5. The Division will require that you include in the total reclamation cost estimate both equipment mobilization and <br />demobilization costs ($480) as well as indirect costs ®20% ($1,676). 'Therefore, assuming no other changes <br />are necessary we have estimated a total reclamation cost of $10,100 for the 23.58 acres of affected land. <br />6. The application lists Benson Brothers as the surface and subsurface owners of the 23.58 acres to be permitted. <br />Although we have no written evidence, we have been made aware by the local citiuns of a public access road <br />covered by stockpiles from the Hallenbeck Pit pl. Please explain. <br />
