Rockcastle is moving forward on this proposal and intends to develop a formal <br />proposal for submission to the Division by May 1, 1990. Rockcastle originally proposed <br />submission of this proposal by Friday, April 27, 1990. The May 1, 1990 submission date <br />will ensure that the proposal reflects the comments of Dave MacDougall who will be <br />unavailable between April 24-27. <br />Rockcastle's conceptual plan contemplates site reclamation, including backfilling <br />and grading, topsoiling and reseeding, would occur during the 1990 construction season. <br />These reclamation activities would occur in conjunction with a phased bond release <br />program whereby bond monies would be released by CMLRD on the basis of completed <br />reclamation work. The Board would retain necessary bond monies to assure final site <br />reclamation. Following completion of contemplated reclamation, Rockcastle would be <br />released from any further liability and the retained bond monies would remain in <br />possession of the Board to cover future contingencies. Rockcastle would expect that a <br />Board order would define the reclamation schedule, the bond release schedule, the <br />retained bond amount, and the specific terms relating to release of continuing liability. <br />The abatement of NOV C-89-034 and NOV C-90-007 and compliance with Stipulations 5 <br />and 6 of the December 14, 1989 Board Order would be accomplished in conjunction <br />with the provisions of this comprehensive reclamation solution. <br />
