There is one minor item <br />that still needs to be addressed. The reclamation plan revision is not very clear. You state "the <br />groundwater and settling ponds shall be reclaimed in accordance with the existing reclamation plan..." <br />However, the existing reclamation plan does not include any ponds since this was supposed to be a dry <br />pit. If, as you state in the application, "material used to reclaim the ponds shall be taken from existing <br />overburdeNtopsoil piles" means you intend to backfill the ponds, this is acceptable to the Division. As a <br />matter of fact, backfilling the ponds will be required. Please commit to backfilling the ponds to the <br />reclaimed ground elevation. <br />By adding backfilling of the ponds to the reclamation plan, the financial warranty requirement will be <br />increased to $33,580.00 (a $4,680.00 increase). <br />The decision due date for [his revision is January 2, 1998.
