11. The Division has made a negative determination for the presence of prime farmland within <br />the permit area. The decision was based on a December 19, 1979 letter from the Soil <br />Conservation Service ofthe United States Department ofAgriculture that demonstrates that <br />no prime farmland mapping units are found within the permit area (2.07.6(2)(k)). <br />12. Based on information provided in the application, the Division has determined that alluvial <br />valley floors exist within the permit or adjacent area. The alluvial valley floors aze known as <br />Little Grassy Creek, Grassy Creek and Fish Creek (2.07.6(2) and 2.06.8(3)(C)). For <br />additional specific findings concerning these alluvial valley floors please see Section B, XIII. <br />13. The Division has approved the post-mining land use of the operation. It was determined that <br />a return to rangeland and grazing for domestic livestock and wildlife meets the requirements <br />of Rule 4.16 for the permit area (2.07.6(2)(1)). <br />14. Specific approvals have been granted or aze proposed. These approvals are addressed in the <br />following section, Section B (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats (2.07.6(2)(n)). <br />16. As of this time, Seneca Coal Company, the operator, is current in the payment ofreclamation <br />fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />SECTION B- Rule 4 <br />Roads -Rule 4.03 <br />The Seneca II Mine utilized three types of roads within the permit area. Haul Roads were <br />used to haul coal from the pit to the Hayden Station or the Hayden Gulch Loadout. Access <br />Roads and anumber oflight-use roads were used to gain access to monitoring facilities and <br />reclamation areas. All roads within the permit boundary aze depicted on Exhibit 12-1 and <br />discussed in Volume 10, Tab 12. <br />A. Haul Roads <br />There were approximately seventeen miles of haul roads at the Seneca II Mine. A <br />portion of these have been fully reclaimed. There aze now approximately 13.5 miles of <br />haul roads that will be retained as permanent. These roads aze shown on Exhibit 13-2A <br />of the PAP. SCC has designed and constructed the postmine roads to comply with <br />applicable performance standazds. Landowner requests in writing, that the roads remain <br />open for further use, have been received by the Division. <br />
