FORMAL PUBLIC HEARING <br />BATTLE MOUNTAIN RESOURCES, INCORPORATED File No. M-88-112 <br />333 Clay Street, 42nd Floor <br />Houston, TX 77002 <br />All persons wishing to give testimony were sworn. <br />Secs. 15, 16, 17, 20, 21 and 22, T32S, R71W, 6th P.M., Cost lla County, <br />2,200 acres; 112 open pit gold and silver. Status report on Erogress <br />towards completion of 12 Board ordered corrective actions, as amended, <br />and status of -reducing the cyanide concentrations of wastE• stream and <br />waste disposal areas to levels that comply with the permit. <br />Staff presented EXHIBIT A, a Summary of the status of progress on <br />abatement plan requirements (through July 20, 1992). Staff briefly <br />discussed the status of each of the 12 abatement requirements: 1) <br />increased tailings area security--on Juty 10, 1992 the Division was <br />informed that the company had added 6 additional people tc the hazing <br />crew; 2> assessment of environmental impact--satisfied ii April; 3) <br />accelerated frequency of environmental monitoring--cor~tinues; 4) <br />tailings cyanide detoxification--continuing Cy7ox and Hydrogen Peroxide <br />treatments. The operator submitted TR-010, which is a proposal for <br />introduction of the INCO process as a means of tailings treatment, antl <br />the Division is in the process of reviewing adequacy respon>es; 5) leak <br />detection system effluent containment--no additional activity; 6> <br />cyanide detection, interception, containment and remedial treatment-- <br />the company is in the process of drilling the 2 additional ground water <br />monitoring wells which will be hydrologically tested, with an <br />evaluative report due to the Division on August 6, 1992; 7) <br />modification of ore processing methodology--will be completed after <br />installation of ground water monitoring wells, reduction in cyanide <br />levels, etc.; 8) modification of the tailings area reclamation <br />plan--will be completed after the ponds are in compliance; <br />9> modification of the environmental monitoring plan--covered under <br />Nos. 4, 6 and 12 and is continuing; 10) adjustment of financial <br />assurance--will occur if the reclamation plan is amended; 11) critical <br />path project management schedule--the operator is currentl~~ following a <br />management schedule; and 12) modification of monitoring sampling and <br />analysis protocol--the Division is awaiting responses to adequacy <br />concerns forwarded to the operator in June. <br />Staff said the operator is following the proposed protocol for sampling <br />and analysis, and the Division is continuing its bi-monthly sampling <br />and analysis. The Division is awaiting a response to correspondence <br />forwarded to the operator last week in which suggestions were given <br />regarding a procedure for developing the protocol. Staff said this <br />issue should be resolved prior to the August 1992 Board Mee =ing. <br />During its June 1992 Meeting, the Board imposed an additional <br />corrective actions order, including 4 specific items to be addressed by <br />the operator, as well as 2 additional clauses: 1) reduce the tailings <br />
