6 <br />and personnel representing Colorado Yampa Coal Company. Colorado Yampa Coal <br />Company is the sole landholder of the lands requested for release. <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released <br />when the permittee successfully completes backfilling, regrading, and drainage control in <br />accordance with the approved reclamation plan." With regazd to Phase I bond release, the <br />approved reclamation plan for the Eckman Park Mine calls for: <br />The approved backfilling and grading plan can be found in permit section 780, pages 780- <br />1-1 through 780-1-3, and 780-111-1 through 780-115. Approved post-mining topography <br />is depicted on Map 48A. Backfilling was performed to generally conform to topography <br />shown on map 48A. Post-mining topography will generally follow approximate original <br />contours as required by Rule 4.14.2(1). Slope gradient will not exceed 20 degrees. <br />Backfilling was accomplished using a combination of dragline, dozers, and scrapers. Post- <br />mining topography vaziance was approved in 1984 via Technical Revision No. 24. <br />Six (6) permanent drainages will be established on the reclaimed area. These permanent <br />drainages include PG 31-1, PG 31-2, PG 7-1, PG 9/]0-l, PG 9110-2 and PG 51-2. <br />Details of these drainages may be found on Map 48A, Map 9A, and permit section <br />All surface drainage reports to permanent impoundment, Pond A. NPDES discharge <br />monitoring submitted by the operator and kept on file at the Division indicate a long <br />record of compliance with the effluent limitations applicable to this outfall. <br />III. OBSERVATIONS AND FINDINGS <br />Backfilling and grading of the pertinent portions of mine plan areas 51 and 61 occurred from <br />1986-1991. Certified cross-sections of the backfilled pit areas were submitted by the operator <br />and approved by the Division. Division approval of the post-mining topography can be found <br />in letters dated: Mazch 4, 1986, June 6, 1986, May 29, 1989, July 6, 1989, May 30, 1990, August <br />1, 1990, September 26, 1990, October 2, 1990, December 10, 1990, May 6, 1991, June 14, 1991, <br />and October 4, 1991. CYCC submitted copies of these Division approvals as a part of the bond <br />release application. <br />The Division found that the cross-sections generally conformed to the approved post-mining <br />topography. All highwalls were backfilled in accordance with Rule 4.14.1(2)(a). <br />During the October 1996 bond release inspection, the Division surveyed areas 61 and 51 using <br />a Zeiss Elta-3 Total Station.
