Long <br /> Division D~recror <br />Dear Sir/Madam: <br />The Division received a copy of your letter which you sent to the Elbert County Commissioners <br />regarding your concerns and opposition to the expansion of the referenced mine site from a 9.9 <br />acre Limited Impact 110 permit to a 68.7 acre Regular 112 permit. <br />The Division received two letters of concern (objections) to the expansion of the pit so a hearing <br />process will be initiated. The Division has scheduled an Informal Conference as required by Rule <br />1.4.6. The Conference is scheduled for July 21, 2000. It will be held at the Division of Minerals <br />and Geology office in Room 215, 1313 Sherman Street, Denver, Colorado 80203. The hearing <br />will start at 10:00AM. <br />Pursuant to Rule 1.4.6(2), each person objecting to the approval of the application shall set forth <br />the grounds for the objection. Similazly, the Applicant, and any other person supporting the <br />approval of the application, shall present grounds necessary to support the approval. <br />If the objectors do not withdraw their objections after the Informal Conference, it will be <br />necessary to hold aPre-hearing Conference (currently scheduled for September or October, <br />2000) and be presented to the Mined Land Reclamation Board at the regulazly scheduled <br />September or October, 2000 meeting. <br />Pursuant to Rule 1.4.6(2)(a), any interested person may participate in the Informal Conference by <br />submitting written comments or by appeazing in person. <br />Also, pursuant to Rule 1.4.6(2)(b), if any person may be affected or aggrieved by Office or Board <br />action, that person may petition the Office for admission as a party to the matter before the <br />Boazd. Such a petition shall be in writing and shall set forth a brief and plain statement of the <br />facts which entitle that person to be admitted as a party and the matters which the person claims <br />should be decided. The written petition for party status shall be submitted to the Office at the <br />Informal Conference or within five (5) working days after the Informal Conference. Parties to <br />any matter before the Board shall continue to be parties to any action for judicial review <br />following final agency action, pursuant to Section 24-4-106(4), C.R.S., as amended. <br />
