5. On May 6, 1992, the District Court, Water Division 5, in Case No. 91 CW 271, <br />entered a Decree granting conditional water rights to Parkerson Diversion No. 1 in the amount <br />of .50 c.f.s. and Parkerson Diversion No. 2 in the amount of 1.00 c.f.s., each with an <br />appropriation date of December 23, 1991. The decreed uses for Parkerson Diversion No. 1 and <br />Parkerson Diversion No. 2 are irrigation, stock watering, and dust control, gravel washing and <br />moisture control of gravel, all in connection with mining of gravel. The source of the water for <br />each structure is an unnamed draw tributary to the Colorado River. The location of each point <br />of diversion is as follows: <br />Pazkerson Diversion INTO. 1: A point 1,090 feet West and 90 feet North of the SE comer <br />of the N`/zSW'/< of Section 23, Township 1 South, Range 1 East, Ute Principal Meridian. <br />Parkerson Diversion No. 2: A point 500 feet East and 100 feet South of the SW comer <br />of the NW'/<SW'/< of Section 23, Township 1 South, Range 1 East, Ute Principal <br />Meridian. <br />6. In Case No. 94 CW 11, Water Division 5, Parkerson Diversion No. 1 was made <br />absolute in the amount of .50 c.f.s. for the uses of irrigation, dust control and controlling the <br />moisture content of gravel and Pazkerson Diversion No. 2 was made absolute in the amount of <br />1.00 c.f.s. for the use of dust control. Parkerson Diversion No. 1 and Pazkerson Diversion No. <br />2 remained conditional with respect to the decreed uses not made absolute in Case No. 94 CW <br />11. <br />7. Water from Pazkerson Diversion No. 2 was diverted by means of a pump in the <br />amount of .50 c.f.s. and was used for gravel washing and stock watering. <br />8. Water from Pazkerson Diversion No. 2 was diverted by means of a pump in the <br />amount of 1.00 c.f.s. and was used for irrigation, controlling the moisture content of gravel, <br />gravel washing, and stock watering. <br />9. The Division Engineer for Water Division 5 filed a Report of the Division <br />Engineer and Summary of Consultation dated September 1, 1998, stating that a field inspection <br />by the water commissioner revealed the uses and amounts as described in the Application are <br />so, and recommending that the Application should be issued as a ruling by the Referee. <br />The Referee does therefore conclude that the above-captioned Application should be <br />granted and that Parkerson Diversion No. 1 is hereby made absolute in the amount of .50 c.f.s. <br />for gravel washing and stock watering, and Parkerson Diversion No. 2 is made absolute in the <br />2 <br />
