Memo to File M-81-302 -3- June 7. 1997 <br /> crop, horticultural, homesite, recreational, industrial, <br /> or other uses, including food, shelter and ground cover <br /> for wildlife . <br /> (2) The results of these decisions shall be formulated <br /> into a Reclamation Plan, as specified in Subsections <br /> 6 . 3 .4 or 6 . 4 . 5, as required for the size and type of <br /> operation. <br /> Rule 6 .4 . 5 (2) (a) - The Reclamation Plan shall include a <br /> description of the type (s) of reclamation the <br /> Operator/Applicant proposes to achieve in the reclamation of <br /> the affected land, why each was chosen, the amount of acreage <br /> accorded to each, and a general discussion of the methods of <br /> reclamation as related to the mechanics of earthmoving. <br /> Clearly, the statute and the regulations provide that the operator <br /> may modify approved reclamation plans during the term of a permit <br /> through the amendment process, and further provide that it is the <br /> operator that develops the specifics of any proposed reclamation <br /> plan. It is then the Division' s responsibility to determine if the <br /> plan proposed by the operator is adequate to achieve the post- <br /> mining land use selected by the operator and adequate to meet the <br /> performance standards of the statue and regulations. Based on this <br /> analysis, the Boulder County Commissioner' s concerns that the <br /> pending permit amendment is a substantial and detrimental change <br /> from the original reclamation plan is not a basis for denial of the <br /> amendment application. <br /> ISSUE #2 <br /> Revisions to Finished Contours as part of an Overall Grading and <br /> Drainage Plan <br /> Quotes pertinent to the Boulder County Commissioner' s concerns in <br /> this regard, from the letter dated 4/17/97 : <br /> This would include excavation and extension of drainage <br /> channels parallel to the existing flood control levee <br /> surrounding the Deepe Pit. As you may be aware, many concerns <br /> have been recently raised about the accuracy of the existing <br /> floodplain delineations and the impacts that the embankment <br /> and sand and gravel mining reclamation may have on the South <br /> Boulder Creek floodplain. <br /> We have requested that the Federal Emergency Management Agency <br /> (FEMA) withhold certification of the existing embankment as a <br /> flood protection levee pending the determination of the most <br /> appropriate flood mitigation measures for this area.
