City of Thornton Water Resources Administrator, <br />303/538-7612 and Bob Huzjak, GEI Consultants, 303/662-0100 <br />Summary and Resolution of Interaction: The City of Thornton has purchased the Dahlia North <br />Pit and the Flanagan Dahlia Pit (AKA Dahlia South, Permit No. M-1989-066) and intends to <br />use the pits for water storage. Thornton requires an interconnecting pipeline under 88~h Ave <br />to manage the water between the two pits. This pipeline must be installed as soon as possible <br />prior to spring runoff in the South Platte. An `acreage swap° technical revision was submitted <br />in September 2000 to permit the interconnect pipeline project under the Dahlia North <br />reclamation permit. The Division determined that the project must be permitted under an <br />amendment and found the application incomplete. The application will remain incomplete <br />until: <br />• proof of notification to the Adams SCD is provided (Bob Huzjak stated that this is ready for <br />submittal); <br />• proof of legal right to enter the 88th Ave. R.O.W. is provided; <br />• the correct fee for an amendment application is provided (a TR fee was previously submitted <br />for the Application). <br />The 88th Ave. R.O.W. easement is owned by Commerce City. Aright of entry agreement has <br />been drafted and signed by Thornton and three out of five necessary signatures for Commerce <br />City are in place. The final two Commerce City signatures are not currently available due to <br />recent personnel changes and vacations. Thornton requests that the Division accepts the <br />partially signed agreement to call the application complete and allow the public comment <br />period to begin. A fully signed version of the entrance agreement will be provided prior to <br />approval of the amendment. Thornton believes that delay in starting the public comment <br />period until the Commerce City signatories return from vacation may jeopardize their <br />municipal water supply for the summer of 2001. <br />I told the City of Thornton that the Division does not generally accept incomplete applications <br />for review and public comment, but given the circumstances surrounding this application I <br />would consult with the Attorney General's Office. <br />c:\windows\personal\dahlia nosh mif doe <br />G ~ ~ ~d~ N~ L ~ G Ey <br />/ z-~-p° <br />
