This is a report of findings and a request for information as a result of an internal review of the Hayden Gulch Terminal, C-92-081 Applicant Violator System (AVS) databank and Colorado Division of Minerals and Geology (CDMG) AVS files. In this memo, requests for documentation means letters of appointment, letters of resignation, minutes of boazd meetings, etc. Attachment 1 is a schematic of organizations that "owns or controls" (Rule 2.03.4(4)] the applicant according to information in the AVS databank.. With regazd to Hayden Gulch Terminal Inc., I have just ntered into the AVS databank the resignation of Richazd A Navarre as treasurer as of 10/16l971~This entry was made based on a letter of resignation in the AVS files. Also in the files is an appointment of Frank M. Castora as treasurer. There is no information in the file on the termination of Frank M. Castora as treasurer. However, the current information from OSM is that the current treasurer is Steven F. Schaab (appointed 08/25/1998). I have not entered Frank M. Castora as treasurer as this would indicated that there are two treasurers. Please provide me with documentation on the end date of Frank M. Castora as-~ treasurer (if, in fact, he is not a second treasurer). I will then post the AVS databank. Attachment Z is a printout of AVS information on Hayden Gulch Terminal inc. with the posting just made. Attachment 3 relates to Peabody Holding Co Inc. Note that there are two controllers listed, Thomas G. Goodman. begin date 10/14198, and Terry L. Bethel, begin date 10/16/1997. I suspect the Goodman appointment supersedes the Bethel appointment. Please provide me with documentation on the termination of Bethel as controller, if appropriate.
