Page 2, June 13, 2007 <br />Rule 4.05.18(2) ............................................................................................................................... 6 <br />Rule 4.12(2) .................................................................................................................................... 6 <br />Rule 1.04(136) "Technical revision" means a minor change, including incidental permit <br />boundary revisions, to the terms or requirements of a permit issued under these Rules, which <br />change shall not cause a significant alteration in the operator's reclamation plan. The term <br />includes, but is not limited to, increases in coal production, reduction or termination of approved <br />environmental monitoring programs, or design changes for regulated structures or facilities. <br />The application is appropriate to a technical revision. It includes a design change for a regulated <br />(one that is subject to design criteria of the Rules) structure. <br />Rule 2.05.3(2)(b) Underground Mining. A detailed narrative and appropriate map(s), prepared <br />according to the standards of 2.10, sufficient to describe all proposed surface disturbances to be <br />associated with the underground mining activities within the permit area. Each operation plan <br />shall include a narrative, cross sections, map(s) and timetable(s) sufficient to describe the areal <br />extent of the proposed underground workings and the stratum to be affected. <br />The application is in compliance with this rule. The application is for the repair by replacement <br />of part of an existing structure (Culver C1-5). The replacement includes changes in design as <br />described in Table 44E, and Attachment A of Exhibit 66, including a Pipe Detail for C 1-5 <br />Culvert dated 06/07/07. The structure is shown on Map 54. However, the as-built configuration <br />varies slightly from that depicted on the map (site visit and confirmation telephone call with <br />Henry Barbe on June 13, 2007). Recommend Map 54 be revised, and a detailed design of the <br />lower section of Culvert Cl-5 be added to illustrate the outfall above the rock cliff and the <br />relationship of the diversion, Culvert CS-1, the road, and the river outfall. <br />Rule 2.05.3(3)(a) A description, plans, and drawings, describing the location, construction, <br />modification, use, maintenance and removal of mine support facilities in the permit area <br />including all buildings, structures, utility corridors and other support facilities including but not <br />limited to those listed in 4.04. Plans and drawings shall include a map, to meet the standards <br />prescribed in 2.10, appropriate cross sections, design drawings, and specifications sufficient to <br />demonstrate compliance with 4.04. <br />With the revision described under Rule 2.05.3(2)(b) above, the application would be in <br />compliance with this rule. This repaired-by-replacement structure is modified, but the current <br />structure in the field does not match the current design depicted. <br />Rule 2.05.3(4)(a) General. A general plan and detailed design plan shall be submitted for each <br />sediment pond, impoundment, other treatment facility and diversion proposed to be constructed <br />within the permit area. <br />
