<br /> <br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to approve with conditions Permit Revision <br />Application No. 4, submitted by Bowie Resources Limited for a coal mining permit at the Bowie No. 2 <br />Mine (Permit No. C-1996-083). Approval of this permit revision would revise the current mine plan at <br />the Bowie No. 2 Mine. The operator is proposing to incorporate into the mine plan the longwall and room <br />and pillar mining of the D seam, for an area that is within the Iron Point Tract Federal Coal Lease COC- <br />61209. The proposed mine plan anticipates mining into the first quarter of 2004 at the current rate of 5 <br />nilllion tons per year. This mine plan change does not include the room and pillar mining under Terror <br />Creek, in which the operator would be able to access the B seam coal at the Bowie No. l Mine. That mine <br />plan change is anticipated to be submitted later. <br />This permit revision would incorporate 1675 additional surface acres into the existing permit area, 1616 <br />acres of which are federal and 59 acres of which are private. The total permit area would be 4525 acres <br />with approval of this revision. Federal mineral acreage would account for 2638 acres while private <br />mineral acreage would be 1887 acres. There will not be any new surface disturbance associated with this <br />revision. <br />The Bowie No. 2 Mine is located in Delta County, approximately 5 miles northeast of Paonia, Colorado. <br />The underground operation has an anticipated maximum production capacity of 5 million tons per year. <br />Coal interest is Federal and private, and the surface to be affected is Federal and private land <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including any stipulations, are on file for public inspection at the <br />Colorado Division of Minerals and Geology, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203, the Paonia Public Library, P.O. Box 969, Paonia, CO 81423, and at [he County <br />Clerk's OfSce in Delta County, 5th & Palmer, Delta, CO 81416. Persons with an interest that may be <br />adversely affected by the proposed decision may request a formal hearing before the Mined Land <br />Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the <br />initial publication of this notice. must be in writing, and must state with reasonable specificity the reasons <br />for the request and the objections to the proposed decision. <br />
