• • iii iiiiiiiiiiiii iii <br />999 <br />ENERGY FUELS MIMNG COMPANY <br />RATON CREEK MINE <br />BOND RELEASE APPLICATION <br />SANTA FE LOADOUTS NO. 1 AND 2 <br />IIVTRODUCTION <br />The Energy Fuels Mining Company (Energy Fuels) completed all required reclamation of the <br />Santa Fe (SF) Loadouts No. 1 and 2 according to the approved reclamation plan. This <br />application requests release of the bond amount associated with reclamation of the SF <br />Loadouts. The reclamation work was completed in early-1994. <br />This bond release request is formatted to effect compliance with applicable provisions of Rule <br />3.03.2. It includes the proposed notice of intent to seek bond release to be sent to adjoining <br />property owners, surface owners, appropriate local governmental bodies, municipalities, <br />county commissioners, planning agencies, sewage and water treatment authorities, water <br />conservancy districts, and to be published in the local newspaper per Rule 3.03.2(1). <br />BOND RELEASE INFORMATION <br />Energy Fuels is submitting this request for bond release effective August 9, 1995. The request <br />references the Division of Minerals and Geology Permit No. C-82-055, originally issued on <br />August 17, 1982, for the Raton Creek Mine. Energy Fuels requests Phase I, II, and III bond <br />release for 3.32 acres of disturbance at the SF Loadouts. <br />Bond surety is provided by National Union Fire Insurance Company of Pittsburgh, PA under <br />bond nos. 13-20-17 and 13-20-18 for $204,524 and $1,307 respectively; a total surety of <br />$205,831. The original, and current, total amount of bond for the area requested for release <br />is $8,963 Energy Fuels requests release of the $8,963 bond amount associated with <br />reclamation of the SF loadouts. <br />The legal description of the area requested for bond release is provided on the accompanying <br />proposed public notice. <br />Energy Fuels initiated reclamation in 1993 and completed the work in 1994. Reclamation <br />involved removal from the site of all coal handling structures and equipment, removal of <br />excess road materials, backfilling the sub-grade hopper structure, and regrading the sites <br />according to the railway company specifications. The coal handling equipment was purchased <br />and removed by a used equipment contractor. Coal-laden surface material was excavated from <br />the sites and hauled to the Mine Site. All excess road material and concrete was hauled off <br />site by a contractor to an approved landfill. Site drainage was established in accordance with <br />the reclamation plan, with silt fences constructed for end-point sediment control. No topsoil <br />application or revegetation work was done in accordance with the reclamation plan. The <br />completed reclamation returned the sites to a configuration compatible with the postmining <br />use of industrial. <br />
