Cottony <br />Division Director <br />Natural Resource Trustee <br />Listed below aze adequacy review comments for the La Florida Pit 110(c) Conversion Application, File No. M-1987- <br />097. Your response to the following adequacy review concems should be submitted to the Division as soon as <br />possible. <br />1. As required by Rule 1.65 (2), please submit the proof of publication of the public notice circulated in the <br />local newspaper and all owners of record of surface lands, and easement holders that are on the affected land <br />and within 200 feet of the boundary of the affected land. The Applicant has submitted the proof of <br />publication but not proof of notice to owners or record of surface lands and easement holders that are on the <br />affected land and within 200 feet of the boundary of the affected land. Please supply these proofs of notices <br />or specify whether the specified lands are all owned by the landowner of the surface rights and materials to be <br />mined. <br />2. Rule 6.2.1(2) requires that maps be prepared and signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please submit the proper, signed <br />maps to the Division. <br />Rule 6.4.6 Exhibit F- Reclamation Plan Man <br />3. Section (a) of the Reclamation Plan Map requires the Operator/Applicant to submit a map depicting the expected <br />physical appearance of the area of the affected land, correlated to the proposed mining and reclamation timetables. <br />The map must show proposed topography of the area with contour lines of sufficient detail to pomay the direction <br />and rate of slope of all reclaimed lands. The appropriate map must show the proposed permit boundary and the <br />proposed, reclaimed topography of the site. Please submit the appropriate map. <br />Please be advised that the Conejos County 110(c) conversion Application may be deemed inadequate, and the <br />application may be denied unless the above mentioned adequacy review items are addressed to the satisfaction of the <br />Division. Responses to these adequacy concems must be received by the Division to allow adequate time for review <br />prior to the decision date.
